.
The history of American Indian relations is not one I have examined.
It is abusive and one sided.
I think the Cherokee are wrong but I will sleep before I prove it.
I need to check the date of emancipation in territories not in revolt.

Total abolition of slavery was finalized by the Thirteenth Amendment which took effect in December 1865.
The Cherokee treaty of 1866.
http://en.wikipedia.org/wiki/Cherokee#Reconstruction_and_late_19th_century
"The pro-Union faction of Cherokee Nation issued the Cherokee Emancipation Proclamation in 1863.[51] After the Civil War, the US government and the Cherokee Nation signed the 1866 Treaty, which among other clauses, says that all Cherokee freedman and all free African-Americans living within tribal lands "shall have all the rights of native Cherokees."[52] Both before and after the Civil War, some Cherokee intermarried or had relationships with African Americans, just as they had with whites. Many Cherokee Freedmen were active politically within the tribe."
The Cherokee Supreme court has some explaining to do.
Andrew Jackson is not a good role model.

Define 'Real Indians' - Room for Debate
The intersection of race and citizenship in Indian Country never fails to create a tragicomedy of tribal politics.
We need some facts.  They may not be here.
    The facts are confused.

Tribal Sovereignty vs. Racial Justice - Room for Debate
Was the Cherokee Nation's expulsion of black Freedmen an act of tribal sovereignty or of racial discrimination?

Can Israel Survive Without a Palestine? - Room for Debate
Abbas and Netanyahu are at a stalemate on the statehood issue. Wouldn't Israel be better off with a viable Palestine?
I do not think it can be done.
I do not think it should be done.
There should be one state.  That state must deal fairly with all its residents.

Israel Is Not a Superpower - Room for Debate
Hatred of Israel in the Arab world is not sufficient reason for prolonging the frozen posture that the Israeli government has adopted.
I think this is a misconstruction of the Islamic position.
I do not know how to fix things from here.

The True Meaning of Sovereignty - Room for Debate
The question is not whether or not tribal sovereignty supersedes racism, but what kind of sovereignty is being defined by tribes when they enact race-based discrimination.
    Not a bad plea.
The Federal government should back off.  Racism has no place in governance.  Are the benefits in question to the individuals or the tribe as a whole?

Being an Indian: It's About Ancestry - Room for Debate
Being Cherokee is not about what you look like, but is about your ancestry and clan.
The Dawes rolls seem a very poor base for decision making.
The 1866 treaty made the freedmen Indian.

The Use of Blood Quantum - Room for Debate
The Cherokee Nation is not the only American Indian tribe that uses blood distinctions to restrict tribal citizenship, privileges and benefits.
So there is more than one injustice.  Does that reduce injustice in the world? No.

Slavery's Long Shadow - Room for Debate
The Cherokee Nation said it expelled the Freedmen not because they were black, but because they were not Indian.
By the "Jim Crow" laws of post reconstruction they are all colored.
The Civil War was not simple for the Cherokee.  They need to resolve these problems.  We can't help.  If the freedmen are not Cherokee they are U.S. citizens with rights in state and federal courts who have suffered a tort.  It is time to call on the  lawyers.

I will get back to the Cherokee.
I would like to know more about the internal fight.
I will sleep now.
