Sheldon Silver’s Lawyers Are Likely to Argue U.S. Failed to Prove Quid Pro Quo

The defense’s pledge to file “vigorous post-trial motions” seeking to have the verdict set aside offer a preview of how it would appeal Mr. Silver’s conviction on graft charges.

The jury saw the quid pro quo.
Sheldon Silver will go to jail.
His pension is at risk.

E.P.A. Announces Biofuel Levels for 2016

The agency increased the total volume of renewable fuel required by the end of 2016 to 18.11 billion gallons, an 11 percent increase from 2014.

The argument against serves the oil industry.

"The 2009 RFS is also pushing up against what is known as the "blend wall". To address the blend wall issue, DOE and others are studying the use of mid-range blends, such as E15 and E20, for use in standard gasoline-burning vehicles. Allowing all gasoline blends to contain up to 20% ethanol would double the potential market for ethanol.[13]"

http://www.eenews.net/stories/1060019596

"Ethanol groups, on the other hand, have heavily criticized the proposal for falling short of the full levels that Congress wrote into the statute. They say that the blend wall is of refiners' own making and that they could have avoided it by investing in infrastructure to add more ethanol to gasoline."

The refiners have a problem and will not fix it.
Higher percentage mixes exist and can be required.
The price of the result will rise a few percent.  The demand for petroleum and the price will fall furthur.
We will get less mileage and burn less fossil carbon.
