Colorado: Court Will Examine Fracking Bans

The State Supreme Court agreed Monday to decide whether cities can ban hydraulic fracturing.

As the economics of oil stand the matter looks moot.
Localities can and do control land use.  That control is called zoning.
Localities can ban drilling rigs.
No rig, no drilling, no fracking.
There is a problem with horizontal drilling.
The area of the ban will have to be large.  Drill strings can be several miles.
