He is rightly skeptical about federal agencies making rules by interpreting laws passed by Congress.

 The power of the executive agencies is different from the interpretive power of the judges.
The Congress demands rules that have an effect.
The executive agencies write the rules that achieve the desired effect.
The judges decide after hearing argument whether those rules are possible and when the rules are violated.
