Judge Finds Fault With Gag Order in U.S. Attorney’s Subpoena

Judge Raymond J. Dearie ordered the office to produce a report on how often unapproved gag orders have been included in past subpoenas.

"At a hearing on Thursday, Judge Dearie, who headed the same federal prosecutor’s office in the mid-1980s, said he expected a full accounting of whether prosecutors have been inserting similar warnings into other subpoenas. It was important, the judge said, to make sure “the assistants in the trenches get the message they are not at liberty to add language to grand jury subpoenas.”"

The prosecutors lose the accountants records as evidence.
