The first person in the line can see all hats but his own.  He or she must select black or white.  Being wrong gets him eaten.
The group can institute a rule. 
A person in ignorance must select the opposite of the hat on the next person. this will tell that next person their hat shade. 
Person one informs person two. person one may or may not be eaten.  Person two will not be eaten.  Person three is in ignorance and informs person four. Person five does not know and informs person six. Person seven informs person eight. Person nine informs person ten.  
Half will survive.  The other half may survive.
I have no better solution.
