My thinking is:
Racism found in in North america is an artificial creation of English colonial rule in the late seventeenth century. The manipulation of the social order was a moral matter and as such it would have been passed on by the established church, The
Church of England, in Virginia and places to the south. There was no separation of church and state at that time. The head of the church was the king. thus responsibilities of the church were responsibilities of the crown. Alternatively if it was considered a civil matter it was directly the responsibility of the crown.
Any reparations owed would be the responsibility of the crown which was responsible for the tort.
